Version: October 11, 2026
This agreement governs participation in athletic training, fitness activities, memberships, lessons, programs, and other services offered by The U Developmental Training Facility (“The U”).
The participant is the individual identified in their Gymdesk registration record. Participants age 18 or older may sign for themselves. A parent or legal guardian must sign for participants under 18.
By signing this agreement, I acknowledge and accept the following terms.
1. PARTICIPATION AND TRAINING ACTIVITIES
The U provides athletic development and fitness services, including:
- Baseball and softball instruction
- Hitting, pitching, throwing, and fielding development
- Strength and conditioning
- Biomechanical and movement training
- Speed, agility, and athletic performance training
- Private and group lessons
- Camps, clinics, seasonal programs, and memberships
- Remote coaching and individualized programming
- Adult fitness and general facility use
This agreement applies to participation beginning on the date signed and continuing until replaced or updated.
2. ACKNOWLEDGMENT OF RISKS
I understand that athletic training and physical exercise involve inherent risks, including muscle strains, sprains, fractures, collisions, falls, injuries involving equipment or balls, dehydration, heat illness, cardiovascular events, head or spinal injuries, permanent disability, and death.
I voluntarily choose to participate, or authorize my child to participate, with knowledge of these risks.
I agree to follow reasonable safety instructions and understand that athletic results and performance improvements are not guaranteed.
Nothing in this agreement releases or limits liability that cannot lawfully be excluded under Louisiana law, including liability for physical injury or intentional or gross fault.
3. HEALTH AND EMERGENCY MEDICAL AUTHORIZATION
I agree to disclose relevant medical conditions, allergies, injuries, or physical restrictions that may affect safe participation.
I understand that participants should immediately notify staff if they experience pain, dizziness, illness, or injury.
In an emergency when consent cannot reasonably be obtained, I authorize The U staff to contact emergency services and seek appropriate medical assistance.
I understand that medical expenses may be my responsibility to the extent permitted by law. This provision does not waive claims against a legally responsible party.
4. FACILITY RULES AND CONDUCT
All participants and accompanying family members must follow facility rules and staff instructions.
Participants are expected to:
- Respect coaches, athletes, staff, and other families.
- Use equipment only as instructed.
- Arrive prepared and on time.
- Follow safety procedures.
- Avoid dangerous, disruptive, or inappropriate conduct.
- Report injuries or unsafe conditions immediately.
- Respect facility property and training areas.
The U may restrict or discontinue participation for safety concerns or violations of facility rules, subject to applicable law and refund obligations.
5. BOOKING AND CANCELLATION POLICY
Private Lessons and Small-Group Sessions
Appointments must be canceled or rescheduled at least 24 hours before the scheduled start time.
- Cancellations made at least 24 hours in advance allow the session credit to be retained for future booking, subject to its original expiration date.
- Cancellations made less than 24 hours before the session may result in forfeiture of the session credit.
- Failure to attend without notice results in forfeiture of the session credit.
- Missed appointments are not automatically refundable or eligible for replacement sessions.
Cancellations must be submitted through Gymdesk or directly communicated to The U staff.
Classes and Recurring Training Sessions
Participants are encouraged to cancel their reservations when unable to attend.
Missed classes do not automatically qualify for refunds, additional sessions, or extensions of membership periods.
For programs with limited weekly attendance credits, missed reservations may count toward the participant’s available sessions if they are not canceled before the scheduled class.
Emergencies and Illness
The U understands that emergencies, unexpected illness, and circumstances beyond a family’s control may occur.
Management may approve an exception, replacement session, or restored credit at its discretion, subject to applicable law.
6. NO-SHOW AND LATE ARRIVAL POLICY
A no-show occurs when a participant fails to attend a scheduled appointment without canceling or notifying The U.
- No-shows for private or small-group appointments result in forfeiture of the scheduled session credit.
- Late arrivals do not extend the scheduled appointment.
- Sessions end at their originally scheduled time.
- If a participant arrives too late to participate safely or meaningfully, staff may decline the remaining session.
Repeated missed appointments may result in booking restrictions, subject to applicable law and the participant’s service terms.
7. FACILITY CANCELLATIONS AND SCHEDULE CHANGES
The U reserves the right to adjust schedules, instructors, class availability, and training locations when reasonably necessary.
If The U cancels a paid session and cannot provide the purchased service, the participant will receive an appropriate replacement session, credit, or refund as required by the applicable service terms and law.
The U will make reasonable efforts to notify affected participants of schedule changes.
8. MEMBERSHIP BILLING AND CANCELLATION
Membership prices, billing frequency, included services, and minimum commitments are determined by the specific membership selected at enrollment.
For recurring month-to-month memberships without a fixed minimum commitment:
- Memberships continue until canceled.
- Cancellation requests should be submitted through Gymdesk or in writing to The U before the next scheduled billing date.
- Cancellation stops future recurring charges after the applicable cancellation becomes effective.
- Payments already processed are not automatically refundable.
- Cancellation does not eliminate amounts legitimately owed for services already provided or charges previously authorized.
Fixed-term memberships and seasonal programs are subject to the specific duration, payment schedule, and cancellation terms disclosed and accepted at purchase.
The U will not impose an undisclosed cancellation penalty or additional notice period.
Membership cancellations and renewals will be administered in accordance with applicable Louisiana and federal consumer protection requirements.
9. PACKAGES, CREDITS, AND REFUNDS
Purchased training packages and session credits are subject to the terms disclosed at purchase, including the number of sessions, expiration date, and applicable restrictions.
- Credits are intended for the registered participant unless transfer is expressly permitted.
- Unused credits do not automatically convert to cash refunds.
- Missed sessions may result in forfeiture under the cancellation and no-show policies.
- Package expiration dates must be disclosed at purchase.
- Refund requests will be reviewed under the applicable purchase terms and law.
Nothing in this section limits refund rights required by law.
10. CONFIDENTIALITY AND TRAINING MATERIALS
The U may provide individualized training programs, biomechanical assessments, instructional videos, coaching resources, and proprietary materials.
These materials are intended for the participant’s personal athletic development.
I agree not to sell, reproduce, or commercially distribute The U’s proprietary instructional materials or nonpublic business information without written authorization.
This provision does not restrict publicly available information, lawful reviews, general athletic knowledge, or the participant’s own experiences and performance information.
11. PHOTOGRAPHY, VIDEO RECORDING, AND SOCIAL MEDIA CONSENT
The U regularly captures photographs and videos of athletes during lessons, training sessions, classes, camps, competitions, and other activities.
These materials may be used to showcase athlete development, celebrate achievements, highlight programs, and promote The U.
By signing this agreement, I expressly authorize The U and its authorized representatives to photograph, video record, and use the participating athlete’s image, likeness, voice, and athletic performance for promotional and marketing purposes.
This authorization includes:
- Instagram, Facebook, TikTok, YouTube, and other social media platforms.
- The U’s website and online marketing.
- Promotional advertisements and campaigns.
- Facility displays and printed materials.
- Program announcements and athlete highlights.
I understand and agree that:
- The U may edit, crop, caption, and publish photographs and videos.
- Content may be used without additional approval or financial compensation.
- The athlete’s first name may be used when appropriate.
- Private medical, contact, and account information will not be disclosed under this authorization.
- Content will not knowingly be used in a misleading, defamatory, or exploitative manner.
- This authorization does not permit unrelated third parties to independently sell or license the athlete’s likeness.
MEDIA CONSENT ACKNOWLEDGMENT
My signature on this agreement constitutes affirmative consent to the promotional media uses described above.
If I do not wish to authorize promotional media use, I should not sign this combined agreement. I may request a participant agreement without promotional media authorization.
Declining promotional media consent does not prevent enrollment or participation.
I may withdraw promotional media permission for future use by providing written notice to The U.
Withdrawal does not automatically reverse prior lawful publication. The U will make reasonable efforts to remove previously published content under its control upon request but cannot guarantee removal of third-party reposts or previously distributed printed materials.
For a minor participant, I confirm that I am their parent or legal guardian and have authority to provide this permission.
12. PARENT OR GUARDIAN RESPONSIBILITIES
For participants under 18 years of age:
- A parent or legal guardian is responsible for providing accurate registration and emergency contact information.
- Parents must disclose relevant health or safety concerns.
- Parents are responsible for arranging timely drop-off and pickup.
- The U is not a childcare or general supervision service outside scheduled training activities.
- Minors must follow staff instructions and facility rules.
13. AGREEMENT DURATION AND UPDATES
This agreement becomes effective on the date signed and applies to current and future participation.
The U may update facility policies when reasonably necessary. Material contractual changes require appropriate notice and renewed acceptance where required by law.
A participant who turns 18 must sign their own adult agreement before continuing participation.
14. GOVERNING LAW
This agreement is governed by Louisiana law.
If any provision is found unenforceable, the remaining provisions remain effective to the extent permitted by law.
Nothing in this agreement waives rights or protections that cannot legally be waived.
